Plant patents may be granted to anyone who invents or discovers and asexually reproduces any distinct and new variety of plant.
A Provisional Patent is a way to establish early “claim” without the formality of filing a patent and inventor can use the term “Patent pending” but must file a “non-provisional” patent within 12 months.
